摘要:
近年来我国启动新一轮供给侧结构性改革,在改革推进过程中就业结构体系及劳资关系逐步呈现出新态势。改革的实施已对劳动法制的健全与发展提出新诉求,现行劳动立法面临考验和挑战,因此劳动立法必须与时俱进,克服现存短板,正面回应改革对劳动关系的影响。新形势下要把握正确修法的可行性、目标性导向,对劳动关系主体分类适用、分层保护,构建和配置新型劳资权责体系,给用人单位可持续发展以法制支撑。同时,在本轮改革中要强调政府的“有为”履职,建设新型就业与社会保障体系,即从用人单位、劳动者和政府三方视角全面审视供给侧结构性改革背景下劳动立法的路径,使劳动者权益得到有效保障,经济发展和社会稳定得以有效推进。
Abstract:
In recent years,China has initiated a new round of supply-side structural reform,during which the employment structure system and labor-capital relationship have gradually presented a new trend.The implementation of the reform has put forward new demands for the perfection and development of the labor legal system.The current labor legislation is facing tests and challenges.Labor legislation must keep pace with the times,overcome existing shortcomings and respond positively to the impact of the reformon labor relations.Under the new situation,we should grasp the feasibility and objective orientation of correctly amending the law,classify and apply the subjects of labor relations, protect them indifferent levels,construct and allocate a new system of labor rights and responsibilities,and give legal support to thesustainable development of employingunits.At the same time,in this round of reform,we should emphasize the “active” performance of the government and build a new employment and social security system,that is,from employing units,workers and employing units,the government's tripartite perspective comprehensively examines the path of labor legislation under the background of structural reform on the supply side,so as to effectively guarantee the rights and interests of workers,and effectively promote economic development and social stability.
